Terms of use

Version 2, effective 2 May 2026. Ask Mandla (Pty) Ltd, registration 2025/389046/07.

In plain language: your subscription and the compliant employment of your worker begin on your start date, and you can cancel within a calendar month. You remain the employer and stay in control; AskMandla handles the admin, the contracts, UIF and payslips, and your worker gets a proper record of their employment. When the subscription ends you continue UIF, payslips, COIDA and the Return of Earnings yourself to stay compliant, and the contract with your worker stays in place for you to download any time. Where this summary and the full terms below differ, the full terms apply.

1. Introduction

These Terms govern your access to and use of AskMandla.com, including all services provided through our website or WhatsApp platform. AskMandla is operated by Ask Mandla (Pty) Ltd, registered in South Africa under number 2025/389046/07. We provide employment compliance, HR support, payroll tools and financial-inclusion services for domestic and small-business employers and their employees. By using our services you agree to be bound by these Terms. If you do not accept them, do not use the services.

2. Definitions

Employer: a user who engages domestic or small-business employees and uses AskMandla to manage the employment relationship. Employee: a person employed by an Employer and registered with AskMandla. User: anyone using AskMandla, including Employers and Employees. Services: all employment, compliance, payroll, HR and financial features we provide.

3. Scope of services

AskMandla provides compliant employment contracts, leave and attendance tracking, payslip and payroll calculations, UIF registration and guidance, and optional add-ons such as earned wage access, legal support and performance reviews. Our services are not a substitute for professional legal or financial advice; all guidance is general unless specified.

4. Registration

Employers must give accurate personal and employment information when signing up, which we use to generate contracts and payslips. We may need to verify your identity.

5. Payment

Access to payroll, payslips, leave tracking and support tools requires a paid subscription, charged monthly by pay cycle: R49 a month on a monthly cycle, R98 on a bi-weekly cycle, and R196 on a weekly cycle. This covers all payroll runs in the cycle and is debited at the time of processing. A once-off joining fee of R450 applies at registration, covering account setup, compliance verification and onboarding. A loan-processing fee of R29 (excluding VAT) applies each time we process a loan deduction on your behalf. Third-party payment-gateway fees may apply and are shown at checkout. You fund the account from which salaries and deductions are paid. We may adjust fees on reasonable written notice.

6. The employment relationship

AskMandla is not the legal employer unless separately agreed under an Employer-of-Record agreement. You, the Employer, are responsible for complying with the BCEA, the LRA and the UIF Acts, approving leave, verifying work hours and confirming documents. Employees are expected to submit accurate attendance and leave information and to tell the employer promptly of absence.

7. Termination and suspension

We may suspend or terminate the service if fraud, abuse or unauthorised use is detected, if payments fail or are charged back, or if these Terms are breached. On termination, contracts and records remain stored as the law requires.

8. Privacy and data

All personal data is processed under POPIA and used to generate documentation, calculate wages, manage compliance and provide support. We do not sell personal data; aggregated, anonymised data may be used for analytics. As an Accountable Institution under FICA, we screen employer clients against sanctions, PEP and PIP databases and adverse media through authorised anti-money-laundering providers, at onboarding and on an ongoing basis. This processing is lawful under sections 11(1)(c) and, where relevant, 11(1)(b) of POPIA and does not need your consent. See our privacy page for detail.

9. Disclaimers and liability

The service is provided as is and as available, without warranties. We are not liable for incorrect information you submit, for tax, UIF or legal obligations miscalculated from inaccurate data, or for decisions you or your employee make using our guidance. Our maximum liability is limited to the subscription fees paid in the last three months.

10. Governing law

These Terms are governed by South African law and the Consumer Protection Act. Disputes are heard in the High Court of South Africa, Western Cape Division.

11. Changes to these terms

We may amend these Terms, and will tell you by email or another official channel. Continued use means you accept the update.
